NIW national interest exempt immigrants, also known as high-skilled immigrants, belong to a special category in EB2, because they do not need to provide labor certificates, do not need employer guarantees, high application success rate and application conditions are far lower than EB1A, and are welcomed by the whole family in one step to get a permanent green card. NIW is not limited by industry, English level, language, age, all walks of life can apply, known as the popular United States green card application path.
The applicant must meet one of the requirements of "advanced degree" or "special skills".
1. Advanced degree: Applicants must have a master's degree or above from a U.S. university or the equivalent from another foreign university, and work in a field that requires a bachelor's degree or above, or in a traditional professional field such as a lawyer, doctor, architect, engineer, or teacher. Applicants with only a bachelor's degree plus five years of work experience in a specialized field qualify for an "advanced degree."
2. Special skills: Special skills in the fields of science, art or business that meet at least three of the following conditions:
(1) have received an official academic certificate issued by a college, university or other educational training institution in their field of expertise;
(2) More than 10 years of full-time work experience in their field of expertise, generally required by the previous and current employers to provide proof;
(3) Have a professional license in the relevant field;
(4) Salary or other compensatory assistance received by the applicant as a result of his or her "special skills", including award funding for research projects, etc.;
(5) The applicant is a member of a professional association, and the acquisition of membership is based on personal ability;
(6) Be recognized in their field and make important contributions.
It can be seen from the applicant's past achievements that the future work in the United States can have a beneficial impact on the national interests of the United States.
